Setting Aside a Conviction

The process and guidelines for setting aside a 22nd Circuit Court conviction is a complicated one and assistance by an attorney is strongly recommended. The process is as follows:


You may not apply to set aside if you have a conviction for any of the following:

  1. Felony or Attempted felony that is punishable by Life imprisonment
  2. Felony or Attempted felony for Criminal Sexual Conduct
  3. Traffic Offense
  4. More than ONE conviction

You are eligible to apply if the following time guidelines have been met:

  • Imprisoned - Five years from the date of release from prison
  • Not imprisoned - Five years from the date of conviction
